I.              Introduction

1.       Who are we?

Matexi NV, having its registered office at Franklin Rooseveltlaan 180, 8790 Waregem and with company number 0405.580.655 (hereinafter “Matexi”, “we”, “us” or “our”) is committed to your privacy and considers it important that your personal data are treated with due care and confidentiality, in accordance with applicable privacy and data protection legislation.

 

This privacy statement (hereinafter "Privacy Statement") explains why we ask for your personal data and what we do with them. If you still have questions after reading this Privacy Statement, you can of course always contact us.


This declaration applies to the personal data that Matexi, as data controller, processes. This means that we determine the purpose and means of processing your personal data.


By 'processing personal data' we mean any processing of data that can identify you as a natural person. Which data exactly is meant, is further discussed in this Privacy Statement. The term 'processing' is broad and covers, among other things, the collection, storage, use or distribution of that data.

2.       When does this Privacy Statement apply?

This Privacy Statement applies to the processing of personal data both before and during the provision of our services, and this via the Matexi website (www.matexi.be) (hereinafter "the Website"); and to all activities associated with it or (commercial) relations arising from it or maintained with it.

This Privacy Statement should be read together with the other terms and conditions applicable to the Website.

The data subjects (hereinafter "you", "your") to whom this Privacy Statement is addressed may include the following: (i) the mere visitor to the Website; (ii) the (interested or potential) customer; (iii) the individuals whose personal data we collect as a result of offering our services to customers; (iv) the business partners who assist us in providing our services to customers, e.g. suppliers, subcontractors and/or partners; (v) any individuals associated with any of the aforementioned parties; (vi) applicants or (vii) any other individuals who come into contact with us.

The data of former and potential future business contacts such as customers and business partners will also be treated and secured as best and carefully as possible, in accordance with this Privacy Statement, unless other prevailing conditions apply thereto.

Furthermore, it is possible that Matexi provides services on behalf of a partner and thereby collects and/or processes your personal data as a processor, for that partner as the controller and its purposes. We may then process and transfer your personal data to our partner to the extent necessary for those purposes. In that case, this Privacy Statement does not apply, but the privacy statement of our partner applies. To this end, a processor agreement has been concluded that defines the rights and obligations of each party so that your personal data are processed correctly by each. To exercise your rights in relation to the processing operations we carry out as a processor for a partner, you can in any case contact us, after which we may handle your request ourselves or will pass it on to our partner.

II.             Use of personal data

A. When do we collect your personal data?

 

We collect and process your personal data as a data controller when you use the Website and are involved in the related activities or services offered.

 

In addition, we may receive your personal data from our partners when we provide our services, and further process and use your data for our own purposes. In that case, we are the data controller for this further processing.

 

B. What personal data might we collect?

The following clarifies what data we may process from you depending on your relationship with Matexi. This does not mean that in all cases we will process all your data as listed below. This will always depend on the specific situation and your preferences.

 

Visitors to our Website

If you visit our Website, we may process the data below from you through the use of cookies and through your use of features we have provided on the Website. These functions include filling in a contact form (e.g. to get information about a particular property) on the Website.

As our current, former or interested/potential future customer and if you express an interest in any of Matexi’s services or projects, we may process the data below. The specific data we process will of course depend on the specific relationship you have with us and the services you as a customer call on, have called on or may wish to call on from us.

Business partners

From our (contacts at our) current, former and potential future business partners (e.g. suppliers, contractors, architects, …), we may process the data below. The concrete data we process from you, personal data or not, will of course depend on the specific way in which you assist us as our business partner in the provision of our services to customers.

C. Special categories of personal data

In principle, we will not process special categories of personal data (i.e. data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or the sex life or sexual orientation of a natural person) unless they are transmitted to us with your explicit consent.

 

D. What are the legal grounds we use to process your personal data?

 

We only process your data for legitimate purposes where the processing will always be based on the processing grounds listed in the General Data Protection Regulation.

 

We support the processing of personal data on the following grounds:

 

  1. The processing is necessary for the entering into, performing or terminating an agreement with you as our client or business partner and/or in order to provide you with our services or cooperate with you. Personal data may also be processed at a pre-contractual stage, in preparation for e.g. the purchase of a property or when you apply to join us.

 

  1. The processing is necessary for compliance with a legal or regulatory obligation incumbent on us or on behalf of one of the parties with whom we work (e.g. insurance company), for example pursuant to anti-money laundering legislation (AML) insofar as it applies to certain activities of us or our partners and to the extent necessary.

 

  1. The processing is based on your consent, e.g. when you subscribe to our newsletter, when you ask for more information regarding a specific project or to better inform you about (new) projects that might interest you. This consent is obtained a.o. by voluntarily and directly providing us with your personal data whether or not orally, in writing or via an electronic web form/message.

 

In addition, we may further process your personal data received from our partners for our own purposes if you have given your consent.


You can withdraw your consent at any time by contacting us. We ask that you always confirm a withdrawal of your consent by telephone in writing, or withdraw your consent by e-mail or letter.

 

  1. The processing is based on our legitimate interests which in specific cases outweigh any possible prejudice to your rights and provided specific conditions are met. We consider, for example, sending marketing communications by us or by our associated or affiliated companies to you as one of our interested or existing or former customers from whom we have recent contact details for similar products or services. Due to the nature of the personal data available and the fact that you already want to purchase, already purchase or have purchased similar services from us or our partners, we assess that any potential prejudice to your rights is very limited, while we believe that the information provided, for example on similar projects, may be of interest to you.


Where we rely on this legal ground for processing, we will limit the effects it may have on your privacy by giving you the opportunity to immediately and simply stop such processing for a certain purpose.

 

E. What are the purposes for which we process your personal data?

We use your personal data for the purposes described below. We do not collect and process more and no other types of personal data than those necessary for these purposes. If we wish to process your personal data for a purpose other than that for which the personal data was obtained, we will contact you before further processing of that personal data.

 

We collect and process your personal data for the following distinct purposes:

 

  • operational purposes: for example, to optimise our Website, to keep our services user-friendly, to follow up on your request and/or answer your contact question;

 

  • business purposes:for example to manage relationships with our customers and business partners and to offer or provide you with our services, to inform you about our operation and services, to pass on customer data to business partners in order to provide the services, to invoice our customers for the services provided, to pay our business partners, communication with our employees and business partners regarding the provision of our services to you as our customer or our cooperation with you as our business partner;

 

  • commercial purposes: for example for sending marketing communication, for sending newsletters or for keeping you informed about activities, projects, offers, events, promotions, etc. or for checking your satisfaction as our customer or business partner;

 

  • legal or statutory purposes: for example for legal reasons and procedures, to draft the private deed, in the context of dispute resolution, to comply with legislation and public orders, to meet our internal and external audit requirements, information security or to protect or enforce our rights, privacy, security or property or those of other persons.

 

F. How long do we keep your personal data?

We do not keep your personal data for longer than necessary for the purpose for which the data was collected or is processed.


Since the period for which the data can be kept depends on the purposes for which the data was collected, the storage period may vary in each situation. Sometimes specific legislation will require us to keep the data for a certain period of time. Our personal data retention periods are based on legal requirements and a balancing of your rights and expectations with what is useful and necessary for providing our services.


When it is no longer necessary to process your personal data, we will erase or anonymise your personal data. If this is not (technically or practically) possible, for example because your data is stored in back-up archives or because we have a limited need for records containing information about data subjects who do not want us to contact them again in the future, we will retain your data but will not process it further and delete it as soon as this becomes possible.

 

G. Who do we receive your personal data from?

We may obtain personal data from you directly, from public sources or from business partners/third parties.

If we obtain your data from external sources, in principle you should already have been informed of the possible data transfer to us by this source itself. In any case, if we obtain your data from external (public or non-public) sources and process it in our systems as a data controller, we will inform you about the processing of your data no later than at the time of our first contact with you.

 

H.  How do we secure your personal data?

We attach great importance to data security and have taken the necessary physical and appropriate technical and organisational (precautionary) measures with a view to securing your personal data against loss or any form of unlawful processing.

In the event of a personal data breach, we will comply with all applicable notification obligations relating to such breach.

 

I. Where do we store your personal data?

We store your personal data mainly on IT systems in Belgium. The management of some of our IT systems can be outsourced to third parties where the data is stored in the European Economic Area (EEA). Where we have engaged IT service providers or other business partners located outside the EEA, which means that your data may also be stored outside the above-mentioned countries, we will always comply with the requirements of the General Data Protection Regulation to ensure the adequate protection of your data in these third countries.

 

J. Who do we share your personal data with?

We will not pass on your personal data to third parties except where we are required to do so by law, you consent or where it is necessary for the achievement of any of our aforementioned purposes. Only those personal data strictly necessary for the achievement of any of our aforementioned purposes will be passed on.

Where necessary, we rely on (external) service providers, so-called "processors", who, where appropriate, carry out certain processing of personal data on our behalf. We will only share your personal data with these (external) service providers to the extent necessary for the relevant purpose. The data may not be used by them for purposes other than those set out in this Privacy Statement. Moreover, these service providers are contractually bound to ensure the confidentiality of your personal data by means of a so-called “data processing agreement" concluded with these parties.

Specifically, to the extent necessary as specified below, we share your data with the following entities for the following purposes, with these entities acting as processors on our behalf in certain cases:

  • the processors that assist us in the IT field in carrying out our activities, e.g. with a view to efficient digital data management, marketing and/or company software;
  • business partners we call upon in the context of offering and providing our services, to enable them to assist us in providing our services to you as our client (e.g. external communications agency, real estate websites);
  • postal, transport and delivery companies;
  • payment service providers;
  • affiliated or associated companies with Matexi where we believe it is appropriate to involve them in a service or potential service
  • public bodies and practitioners of regulated professions such as notaries and lawyers, for the purpose of complying with our legal obligations as a company, and the efficient defence of our interests in the context of any legal dispute, as regards the data strictly necessary for this purpose.

The transfer of your data to the parties identified above for the stated purposes is based, as the case may be, on (1) the necessity of this for the performance of the agreement we have with you as our customer, prospective tenant or business partner, or to take action at your request prior to the conclusion of such agreement, (2) our legitimate interests, (3) the necessity of this to comply with a legal obligation incumbent upon us, or (4) your consent.

III.             What are your rights regarding your personal data?

You dispose of various rights regarding the personal data collected about you. If you wish to invoke any of the following rights, please contact us by e-mail or by post using the contact details above.

 

You have the following rights:

 

  • Right of access and copy: if you wish, you can access your personal data and obtain a copy of it;

 

  • Right to modification and rectification: if you believe that we have inaccurate data about you, you can let us know and we will rectify it for you; if possible, you can also modify it yourself through our services;

 

  • Right to erasure (right to be forgotten): if you wish, you can ask us to erase your personal data. However, we may still need to process that data for other purposes;

 

  • Right to restriction of processing: if you believe that we are processing your personal data unlawfully or incorrectly, you can also have this processing restricted;

 

  • Right to object: you can also object to the processing of your personal data. If it concerns marketing, we will cease processing as soon as possible;

 

  • Right to data portability: if you wish to transfer your personal data, please contact us.

 

However, the exercise of the above rights is subject to certain exceptions to protect the public interest, our interests and interests of other individuals, in accordance with the provisions of applicable privacy and data protection legislation.


When you make a request to exercise your rights, we will first of all verify your identity by requesting e.g. a copy of your identity card if necessary. We do this to prevent your data from falling into the wrong hands.


In principle, exercising your rights is free of charge. If your request is manifestly unfounded or excessive, we may charge you a reasonable fee in light of the administrative costs incurred by us. In the same case, however, we may choose not to act on your request. If necessary, you will always be informed of the reasons for this.


In any case, we will inform you of the action taken on your request within four weeks (for simple requests) or three months (for complex or multiple requests).

Despite our best efforts to protect your privacy and comply with the relevant privacy legislation, you may have further questions, or disagree with the way we collect, use and/or process your personal data.

The Website may contain references (e.g. via hyperlinks) to other websites provided by other external, unrelated companies or randomly by a social media platform. Matexi is not responsible for the processing of personal data through those external websites. Nor does this Privacy Statement apply to those websites.

If you share content via social media, your personal data will be visible to visitors of those social media platforms. Matexi is not responsible for the processing of personal data through those social media. Nor does this Privacy Statement apply to those social media.

VI.              Amendments

We may unilaterally decide to make changes to this Privacy Statement. In that case, the new version will take effect immediately. The most recent version is available on our Websites at all times. In case of a substantial change to this Privacy Statement relevant to you, we will - to the extent possible - inform you directly.
